A DPO is mandatory when you: (1) are a public authority, (2) carry out large-scale systematic monitoring of individuals, or (3) process special categories of personal data on a large scale. Some sector-specific laws also require a DPO.
Yes, the GDPR explicitly allows external DPOs (Art. 37(6)). An external DPO must meet the same requirements: expertise in data protection law, independence, and no conflicts of interest.
